The terms of using this site. Your engagement has its own.
Short, and about the site only: reading it, subscribing, running the calculator, asking for a call. If we build something for you, the agreement we sign covers that work, not this page.
Who you are dealing with
This site is operated by Stack & Lever Inc., a corporation incorporated in Ontario, Canada. Where this page says we, us or our, that is the company. Where it says you, that is whoever is reading or using the site.
What this page covers, and what it does not
This page covers using stackandlever.com: reading it, subscribing to the newsletter, running the calculator, and asking us for a call. That is the whole of it.
It does not govern client work. If we build something for you, a signed agreement covers that engagement, and it sets the terms for deliverables, ownership, confidentiality and fees. Where this page and that agreement ever appear to disagree, the agreement is the one that counts, and nothing here changes, limits or adds to it.
Using the site
Read it, quote it, send it to whoever you like. What we ask you not to do is narrow:
- Break it on purpose, or try to reach parts of it that are not public.
- Scrape it at a rate that degrades it for anyone else.
- Republish it as your own work, or pass our writing off as someone else's.
- Use it to do something illegal, which we mention only because a terms page that omits it is incomplete.
The newsletter
Subscribing is express consent under Canada's anti-spam legislation, and you give it by entering your address and submitting the form. It is one email a week. Every one carries an unsubscribe link, it works immediately, and you never have to email anyone to ask. We do not sell, rent or share the list. What we keep and for how long is set out on the privacy page.
The calculator is an estimate, not a quote
The cost calculator takes the numbers you enter and does the math on them. It is a way of thinking about the scale of a problem, and it is worth exactly what the inputs are worth. It is not a measurement of your business, not a promise of a result, and not a price.
A price comes from a conversation, in writing, after we have looked at how your week actually runs. Nothing the calculator displays or emails you binds either of us.
Booking a call
Asking for a call is not a contract and costs you nothing. Either of us can decide it is not a fit, and we will say so plainly rather than let it drift. Scheduling runs through Calendly, which is a separate company with its own terms and its own privacy policy; when you pick a time there, you are using their service as well as ours.
What is ours
The writing, design, photography, code and the Stack & Lever name and mark on this site are ours. Quoting us with attribution is welcome and needs no permission. Reproducing the site, or using the name or mark in a way that suggests we endorse or are involved with something we are not, is not.
Where we link out
Some links leave this site. We choose them carefully and we do not control them, so we cannot stand behind what they say or do. Their terms apply once you are there.
What we do and do not promise
We stand behind the accuracy of what we publish here and we correct it when it is wrong. What we cannot promise is that the site is available without interruption, or that anything you read here will produce a particular result in your business. Case studies describe what happened for one client, under their conditions, and are not a forecast for yours.
Nothing here is legal, accounting or tax advice. To the extent the law allows, we are not liable for losses arising from your use of the site itself. This does not limit anything that cannot be limited under Ontario or Canadian law, and it does not touch obligations we take on in a signed agreement.
Which law applies
These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there, and the courts of Ontario have jurisdiction over any dispute about them.
Changes
If we change these terms we will update this page and move the date at the top of it. The date is how you tell which version was in force when you read it. Continuing to use the site after a change means the updated terms apply.
